A Talladega county jury found 28 year old Takarius Jebraun
Turner, of Talladega, not guilty of two
counts of burglary in the first degree .
Turner stood trial last week, but required medical
attention after the jury began deliberating. He was still in the hospital last
week when the jury came back with the verdict.
Circuit Judge Julian King sealed the verdict and sent the
jury home until all of them and the defendant were available to hear it in open
court at the same time.
Turner was accused of breaking into the home of Timothy
Wilson on Scott Street in November 2012. A gunfight ensued, leaving both Turner
and Wilson wounded. Both men were transported to University of Alabama
Birmingham Medical Center for treatment.
Wilson’s cousin said he heard the fight, but didn’t see
it. The cousin also declined to let police search the house in the immediate
wake of the incident and moved Wilson’s gun afterward.
The jury at first found Turner guilty of the lesser
included offense of assault in the second degree and acquitted altogether on
the second count.
King said the two verdicts were inconsistent with each
other, and he sent them back Wednesday for further deliberation. They returned
with acquittals on both counts shortly afterward.
