Anniston man indicted for manslaughter in 2013 traffic death

An Anniston man is facing charges of manslaughter and assault in the death of a Jacksonville woman killed in a wreck last year.  Richard Nelson Davis Jr. was arrested on Friday at his McClellan workplace by Calhoun County sheriff’s deputies. He was released later that day from the Calhoun County Jail on a $200,000 bond. A Calhoun County grand jury indicted Davis on charges of manslaughter and first-degree assault March 10. Prosecutors say that Davis was driving on Alabama 204 west of Jacksonville on May 5, 2013, when his SUV struck two other vehicles, killing 41-year-old Kimberly McCoy of Jacksonville and injuring 20-year-old Cody Phillips, also of Jacksonville. The accident report notes Davis was driving east on Alabama 204 near the intersection of Lloyd’s Road when his 2002 Chevy Tahoe crossed into the westbound lane, striking McCoy’s 1999 Honda Accord head-on. Davis’ car overturned and was hit by Phillips’ 1999 Ford F150, according to the report. A trooper who responded to the accident smelled alcohol coming from Davis, according to the report. A test conducted at the scene showed Davis’ blood was 0.134 percent alcohol, according to the report. The legal limit in Alabama is 0.08 percent. Court records show Davis pleaded guilty in August of last year to driving under the influence of alcohol in that May 5 wreck. Those records show Davis was sentenced to 60 days in jail, required to complete 30 days of community service and two years of probation, and was fined $1,400. Davis failed to show for two out of the five required community service work days last year, according to court records.
