An Etowah County woman charged with the murder of her
granddaughter is making a request to the judge over her case. Joyce
Garrard faces a possible death sentence if convicted of capital murder. Her
attorneys are asking a judge to bar lawyers from eliminating potential jurors
who oppose capital punishment. Her
attorneys say barring death penalty opponents is unconstitutional, because it
would result in more jurors likely to vote for a conviction. A judge will make a decision on the request
August 18th. Garrard is accused of forcing nine-year-old
Savannah Hardin run as punishment until she collapsed and later died in 2012.
Trial is set for September 22nd.
