Grand Jury to hear Animal Abuse case

A Calhoun County judge decided Monday that a grand jury will hear evidence against an Anniston bar owner accused of abusing a dog.
49 year old David Martin Mogil,  owner of Damn Yankee's Oyster Bar, was arrested in November for allegedly hitting a dog. Mogil's attorney, Bill Broome, said his client is "disappointed" in the news.
Witnesses told police they saw the dog being beaten with a piece of garden hose on the second story balcony of Mogil's bar. The dog then jumped off the second story balcony, according to witnesses. According to Broome, Mogil did have a rubber hose on the balcony but was using it to break up frozen animal waste on the deck.
Mogil is still listed as an inmate in the Calhoun County Jail under no bond. It was revoked from an earlier arrest for allegedly assaulting an Anniston Police officer.
The dog's owner, 30 year old Mary Allison Barrett,  of Anniston, was also arrested in connection to the case for hindering prosecution.

Police say the dog in the case has been placed in a new home.
