Etowah Grandmother charged in grandaughters death seeks to have murder charge dismissed

A hearing is scheduled for today in a Gadsden courtroom in the case of a 9-year-old Etowah county girl who was allegedly run to death.  Etowah County Circuit Judge William Ogletree has set a hearing for Joyce Hardin Garrard. Garrard has asked Ogletree to dismiss a charge accusing her of capital murder in the 2012 death of her granddaughter Savannah Hardin. Prosecutors say Garrard made the girl run for three hours as punishment for a lie about eating a candy bar. The child collapsed and died three days later. Savannah Hardin's stepmother, Jessica Mae Hardin, is charged with murder for allegedly allowing the punishment to take place.
